Terms of Service

By commissioning me you agree to my terms of service.

📝 INTELLECTUAL PROPERTY

Credit must be given to me, HumieArt, when commissioned artwork is used and posted online.
For vtuber models, credit must be given in the bio. For stream assets, I would like to be added to your public credit page.
I, the artist, reserve the copyrights on my commissioned artworks.
You may not resell or use the artwork for commercial purposes (prints, merch, etc.) without prior agreement.
AI, NFT, Crypto use is strictly prohibited.
You cannot make changes to the artwork unless we discuss it beforehand.

⚖️ TAXES

I am legally required to collect private information (such as your real name) to comply with my country's tax regulations, therefore I can only accept commissions from clients who provide these details.
I guarantee the privacy of your information and expect you to respect mine as well.
Please address me as Humie online and DO NOT leak my info.

🧾 PAY & REFUND

I only accept payment made with credit/debit card via Stripe (it's a secured and known payment platform, you don't have to have a Stripe account to be able to pay).
I will either send you a Stripe invoice to your email or ask you to pay on my Ko-fi.
The currency will be EURO (€).
Commissions do not function on a first-come first-served basis. The accepted requests will be based on how well I'll be able to draw the character in order to ensure quality work, so slots are not guaranteed.
Commissions under 300€ require one full upfront payment: you have 24 hours to pay.
No refunds.

⏱️ PAYMENT PLAN

Split payments are acceptable for orders above 300€: We can discuss in DM for a monthly or bi-weekly payment plan that works best for both parties.
No refunds for a payment plan.
If you wish to start a payment plan at a later date, you can secure a spot on my waitlist with a non-refundable deposit of 100€. This amount will be deducted from the final price once the full payment is completed.
Please note that due to supply and demand, my prices may change between commission openings. However, if I’ve given you a fixed quote within the last 5 months, that price will remain valid.

📨 DEADLINE

Commissions typically take 2 months to complete after it's 100% paid. I will not send the files if it's not 100% paid.
You can pay a rush fee if you want the art to be completed earlier (TBD 30-50%).
I regularly update the Trello progress tracker and whenever it's possible, I will update you by myself.
You can DM me at any time to ask for a progress update. But do not rush me: please be patient and respectful. I am a human and have other responsibilities, too.
To keep the workflow on schedule, timely & clear feedback is necessary.

📂 FILES

File Storage Policy: After the commission is completed, you will have 2 weeks to download all delivered files from Google Drive or keep a copy. I will not be held responsible for lost files beyond that period.

⚪️ WIPS

By commissioning me, you agree that your artwork may be streamed on Twitch, and WIP images may be shared on my social media.
If you prefer your commission to not be shared online or me to not stream the process, you must inform me. Additional NDA fees may apply.
If you want the art to be ready-to-animate/rig, please tell me in advance!

🎙️ VTUBER COMMISSIONS

Vtuber commissions such as Model art, Live2D rigging, overlay, emotes, stream assets, and panels already streaming use fee.
Vtuber/PNGtuber models are categorized as commercial work, allowing you to use the model for streaming and online content creation.
You must credit me clearly as the model artist on your socials bio and in the Twitch/YouTube credit section.
For companies or talent agencies, prices will be determined through email.
If you wish to resell the model, please notify me first, and do not price it higher than what you paid.
If you win a free model art or Vtuber design from one of my raffles, you may not resell it for personal gain.
You're not allowed to post the original full sized .PSD/PNG file online.
You're not allowed to edit the model. Please contact me if you want either edit or add to the model.
I retain the right to post showcases and commissioned work on my portfolio and social media.
If you’d like to keep the model private until debut, please inform me.
I reserve the right to know which rigger will be working on the model art I create to ensure it is properly showcased.
The completion time follows the duration of the agreed payment plan. This means the project will progress in phases and be completed as payments are made. I will only deliver the files when it's 100% paid.

👤 Personal : profile picture, SNS banner, share on SNS (non advertising) shown on streams or non monetized videos ❯ NO FEE
📺 Asset for stream (use as part of your branding on a monetized site : stream platforms' banner, panels, logo, emotes, overlay, starting / ending / brb scene) ; or to 📢 promote direct revenue (sponsorship posts, event promo, merch promo etc.) ❯ + 50% (Vtuber commissions already included this fee)
🛒 Physical goods (Merchandises) or digital goods (Patreon/Membership reward, digital wallpaper etc.) ❯ TBD depending on the size of project (usually + 100-200%)

🔢 Commission Process : step-by-step

You read and agree to my TOS
You fill in the form with clear references, description and send me your inquiry
You wait for my response: If I accept your request, I will contact you
We discuss brief, quoting, payment, and schedule
I send you the invoice, you pay the invoice
I inform you about 1 week before I start working
When working on it, I will send you work-in-progress screenshots. You need to approve or tell me if you want any adjustments.
Note that I can't make big changes after the coloring stages! So clear feedback is crucial and appreciated.

When did you start drawing?

I've drawn a lot since I was a kid. I used to be in small local art clubs, took oil pastel classes and oil painting classes for 2 years in my teenage, I did some watercolors and had my first sketchbook at 16. I had my first drawing tablet in 2017, but I gave up after 2 months. I bought an iPad in 2020 and picked up digital again. Since Covid, I began to share my art online, participate in art community challenges, and became a freelance artist.

What app do you use?

Procreate app on iPad for drawing in general (including vtuber model)
Clip Studio Paint on PC for 3D model posing and assembling vtuber model parts
Live2D for animation and model rigging

Do you offer [specific commission inquiry]?

The only way to know is to send me a DM on Twitter, Discord, Vgen or email me (artbyhumie@gmail.com). I will tell you if the project is possible as well as my availability.

You can also include a screenshot of a specific artwork or project of mine or from someone else. It will help me to visualize.

Be clear in the message since I will ignore random short messages like "Hi, how are you?".

What brushes do you use?

I use a ton of different preset brushes and free ones that I found online: round brushes, airbrushes, painty, textured, pencil-like brushes... depending on my mood and the effects I want to achieve with the artwork.

I highly recommend downloading any brush sets, experimenting, and tweaking to find the ones that fit you and your process. It's something personal and what fits me might not fit you, and vice versa.

What’s the difference between commissioning me via Vgen or directly?

On Vgen:

Final price + 5% platform fee + 5% transaction fee

Directly (via Google Order Form & Stripe Invoice):

No platform fee – You only pay the final price
I cover the transaction fee myself

Is off-Vgen payment safe?

Absolutely! Payments through Stripe are 100% secure, and I guarantee the same level of care, attention to detail, and on-time delivery as I do for all my clients.
